Regulations for purchasing and redeeming Chill City SPA vouchers

Definitions:

  • Buyer – the person purchasing the Voucher,
  • Recipient – holder of the Voucher indicated by the Buyer during the process of placing an order for a Voucher; a person with full legal capacity,
  • Service provider – MoveCor Łukasz Korowaj with its registered office at ul. Wilczak 20f/12, 60-623 Poznań, NIP: 543-211-22-34
  • Gift voucher – a temporary bearer document for a specific treatment (Voucher) and/or a package of treatments (gift card) for a specific amount or service purchased by the Buyer for the Recipient,
  • Regulations for Gift Vouchers - these Regulations for the purchase and redemption of Gift Vouchers,
  • Regulations for the use of services - applicable at the Service Provider Regulations for the use of services at Chill City SPA of January 1, 2018

GENERAL PROVISIONS

  1. Gift vouchers can be purchased via the website https://sklep.chillcity.pl/ and by phone at +48 530 589 019 or at the Chill City SPA headquarters at Święta Marcin 67 in Poznań
  2. Gift vouchers entitle you to use the services in accordance with the price list applicable at the Service Provider on the day the service is provided.
  3. By placing an order for a Gift Voucher, the Buyer submits an offer to the Service Provider to conclude a Gift Voucher sales contract on the terms specified by the Buyer in the order. The Agreement is concluded by accepting this offer by the Service Provider when the Buyer receives confirmation of the terms of the Gift Voucher sales contract by the Service Provider, sent in an electronic message to the e-mail address provided by the Buyer during the purchasing process.

TERMS AND CONDITIONS OF REDEMPTION OF THE GIFT VOUCHER

  1. A gift voucher entitles the recipient to make a payment for a specific treatment (Voucher) or for any treatment of their choice (gift card), excluding discounts (unless otherwise stated).
  2. The recipient is obliged to book a convenient appointment date in advance (at least a week before the planned visit) by calling the salon's telephone number, in person at the salon or through the reservation system located at: https://booksy.com/pl-pl/71098_chill-city-spa_masaz_15608_poznan?do=invite&_branch_match_id=1227200576505974861&utm_medium =merchant_customer_invite&_branch_referrer=H4sIAAAAAAAAA8soKSkottLXT07J0UvKz88urtRLzs%2FVD7B0SnQqj%2FAJd0wCANaGJ%2BsiAAAA. In this case, when booking a visit, in the notes to the visit, the person is obliged to provide information that the visit is carried out as part of the voucher.
  3. The gift voucher must be presented before using the treatment.
  4. The expiration date can be found on the Gift Voucher.
  5. The gift voucher is valid for up to 6 months from the date of purchase. The Gift Voucher must be used within this period. After the validity period of the Voucher expires, all or part of the unused value is lost.
  6. The gift voucher can only be used by the recipient.
  7. If the reservation is not canceled by phone or in person, 12 hours before the scheduled visit, the gift voucher will be deemed to have been redeemed.
  8. If the value of the service is lower than the value of the Gift Voucher, the Service Provider is not obliged to refund the difference in value. If the value of the service exceeds the value of the Gift Voucher, the Recipient pays the difference.
  9. If the Gift Voucher covers treatments that cannot be performed by the recipient due to contraindications, they can be exchanged for others of the same or similar value.
  10. Gift vouchers cannot be combined with promotions and discounts available from the Service Provider.
  11. After prior consultation, the Gift Voucher can be redeemed during several visits to the Service Provider.
  12. A gift voucher can only be redeemed at the Service Provider from which it was purchased.
  13. A gift voucher can be used to pay for services only during its validity period.
  14. The method of packaging the Gift Voucher and the extras (freebies) it contains depend on the value of the Voucher or the option selected by the customer.
  15. The Gift Vouchers Regulations constitute an integral part of the Gift Vouchers sales contract.
  16. The condition for the provision of the service by the Service Provider is the acceptance of these Regulations by the Buyer.

WITHDRAWAL FROM THE CONTRACTPersonalized vouchers are not refundable or exchangeable for cash. Pursuant to Art. 38 point 3 of the Act on Consumer Rights, the right to withdraw from the contract is not available in the case of purchasing a personalized voucher prepared at the individual request of the customer.

The Ordering Party may withdraw from the purchase contract without giving a reason by submitting an appropriate declaration in writing or electronically to the e-mail address: biuro@chillcity.pl within 14 (fourteen) days from the date of conclusion of the sales contract. This right applies to non-personalized vouchers or products purchased in the Chill City SPA salon or through an online store. The Buyer loses the right to withdraw from the contract in accordance with point 2 above, at the moment of using the Gift Voucher (making a payment with it in accordance with paragraph II point 1). To meet the deadline mentioned in point 2 above, it is enough to send a statement before its expiry. In the event of withdrawal from the contract, the Service Provider returns all received payments to the Buyer, immediately, but no later than 14 (fourteen) days from the date on which the Service Provider was informed about the decision to exercise the right to withdraw. contract. In the event of effective withdrawal from a distance contract, the contract will be deemed not to have been concluded. The Service Provider will refund the payment using the same payment methods selected by the Buyer when placing the order, unless the Buyer has chosen another method of return that will not result in additional costs for the Service Provider. The Buyer is not entitled to withdraw from the contract in relation to the contracts specified in Art. 38 of the Act of May 30, 2014 on consumer rights, in particular contracts: declaration of services, if the entrepreneur has fully performed the service with the express consent of the Consumer, who was informed before the commencement of the service that after the entrepreneur has provided the service, he will lose the right to withdraw from the contract in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to meet his individual needs, and in which the subject of the service are things that, after delivery, due to their nature, are inseparably connected with other things, for the supply of digital content that is not recorded on a tangible medium, if the performance of the service began with the Consumer's express consent before the deadline for withdrawal from the contract and after the entrepreneur informed him about the loss of the right to withdraw from the contract.

PERSONAL DATA PROTECTION As part of the performance of the contract by the Service Provider, personal data of natural persons are processed, within the meaning of Regulation 2016/679 of the European Parliament and of the EU Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and the adoption of Directive 95/46/EC (General Data Protection Regulation), the so-called "GDPR". Wilczak 20f/12, 60–623 PoznańThe Service Provider takes all necessary actions required by the provisions of the GDPR and national regulations in order to ensure an adequate level of protection of the processed personal data. In particular, it applies the security measures referred to in Art. 32 et seq. of the GDPR. Detailed information on the principles of personal data processing is included in the Regulations on the use of services and the Privacy Policy.

FINAL PROVISIONS

The sales contract for Gift Vouchers is concluded in Polish. The Service Provider reserves the right to make changes to the Regulations for Gift Vouchers for important reasons, in particular in the event of changes in legal regulations, changes in payment and delivery methods, if these changes affect the implementation of the provisions of the Regulations. The Service Provider will inform the Buyer electronically about each change at least 7 days in advance. To the extent not regulated by the Regulations on Gift Vouchers, the Regulations on the use of services at Chill City SPA of January 1, 2018 and the Privacy Policy shall apply accordingly. The above-mentioned documents are available on the website www.chillcity.pl. In matters not regulated in the Regulations, generally applicable provisions of Polish law apply, i.e. in particular: the Civil Code, the Act on Consumer Rights, the Act on Personal Data Protection, GDPR. The settlement of any disputes arising between the Service Provider and the Buyer who is not a consumer will be submitted to the court having jurisdiction over the seat of the Service Provider.
